The Importance of Attorney Preparation for Mediation

During my time on the bench, I expected attorneys to be prepared for any given hearing, It did not matter how simple or complex the issues being addressed were. From my perspective, prepared attorneys were able to effectively advocate for their client’s interest, demonstrated professionalism and competence which in turn enhanced their credibility with me and their clients.

Similarly, in the mediation setting, a prepared attorney will be far more effective during the negotiation process. By being prepared, attorneys can provide their clients with a clear understanding of their legal rights and options empowering them to make informed decisions during the mediation process.

Family mediation often involves emotionally charged issues. Prepared attorneys can help manage their clients’ emotions and expectations, in turn increasing the chances of reaching a successful resolution.

Attorneys who are prepared demonstrate professionalism and competence which can enhance their credibility with the mediator and the opposing party facilitating constructive negotiations.

It is my experience as a Mediator, that there is a greater likelihood of the parties reaching an agreement when both attorneys are prepared and have prepared their clients.
